It was recently reported that the Federal Territories Islamic Affairs Department (JAWI) filed an application for leave to appeal to the Federal Court against the decision of the Court of Appeal which upheld an earlier High Court decision against JAWI in favour of Nik Raina Nik Raina Nik Abdul Aziz, the branch manager of the Borders bookstore raided by JAWI.
AMK is disappointed with JAWI’s decision to apply for leave to appeal even after the High Court and the Court of Appeal had ruled against it. The decision meant that Nik Raina’s ordeal will be prolonged as the legal process goes through the motion at the Federal Court level.
AMK calls upon the JAWI to stop making Nik Raina the scapegoat. It was held by the Courts that the seizure of the book by JAWI was unconstitutional.
AMK also question the need to rigorously pursue action against Nik Raina when JAWI’s grouse is with the book in question. Nik Raina is just the branch manager and she cannot be faulted for the availability of the book as it was not banned at that time.
As such, AMK calls upon JAWI to withdraw the application for leave to appeal and not pursue the matter further.
